Terms of Service

01 What the Service does

Flux Swap lets you exchange one crypto asset for another without creating an account. We quote rates from third-party liquidity providers, give you a one-time deposit address, and, once your deposit is confirmed, send the asset you chose to the destination address you provided. Flux Swap is not a bank, broker, custodian or wallet provider, does not hold funds on your behalf beyond what is needed to complete a swap, and does not provide investment, tax or legal advice.

02 Eligibility

You may use the Service only if you are at least 18 years old (or the age of majority where you live) and are legally allowed to do so. You may not use the Service if you are located in, or a resident of, a country or region subject to comprehensive sanctions, or if you are on any sanctions list. You are responsible for making sure that using the Service is lawful where you are.

03 Orders and rates

• Float rate. The amount you receive follows the market and is set when your deposit is confirmed. It may be higher or lower than the estimate shown.
• Fixed rate. The rate is locked when you create the order, provided you send exactly the quoted amount before the order timer expires. If you send a different amount or send late, the order may be processed at the float rate or refunded.
• Private swaps. Private and Private+ swaps route your funds through an intermediate asset and more than one provider. They take longer and the final amount may differ from the estimate.
• All rates shown before an order is created are indicative. Quoted amounts already account for our fee and network fees unless stated otherwise.
• Each deposit address is for one order only. Do not reuse it.

04 Your responsibilities

• You are solely responsible for entering a correct destination address on the correct network, including any memo, tag or destination ID it requires. Blockchain transactions cannot be reversed, and we cannot recover funds sent to a wrong address or network.
• Send only the asset and network shown on the order. Deposits of a different asset or on a different network may be lost or may only be recoverable, at our discretion, after a manual review and fee.
• You must own, or be authorised to use, the funds you send.
• We strongly recommend adding a refund address so we can return funds if a swap cannot be completed.

05 Prohibited use

You may not use the Service to launder money, finance terrorism, evade sanctions, commit fraud, process proceeds of crime, or for any other unlawful purpose. You may not interfere with the Service, attempt to gain unauthorised access to it, or use automated means to abuse it.

06 Compliance holds and refunds

Flux Swap does not require an account or identity verification for ordinary use. However, our liquidity providers screen transactions, and we or they may pause, delay or decline an order that appears linked to illegal activity, sanctioned parties or stolen funds. In that case you may be asked for additional information before the order is completed or refunded. Where we are legally required to, we may withhold funds or report them to the authorities.

If an order cannot be completed, we will refund the deposit, minus network fees, to your refund address, or to an address you provide to support. Refunds are made in the asset you sent unless agreed otherwise.

07 Fees

We charge a service fee that is built into the quoted rate. Blockchain network fees are also deducted. The amount shown as “You get” is what you should expect to receive, subject to the rate rules in section 3.

08 Risks

Crypto assets are highly volatile and can lose value quickly. Blockchains can be congested, forked or fail. Third-party providers, wallets and networks may be delayed or unavailable. By using the Service you accept these risks. Nothing on the Service is a recommendation to buy, sell or hold any asset.

09 Third-party services

Swaps are executed through third-party liquidity providers, and the website shows price data from third-party sources. We are not responsible for the availability, accuracy or conduct of third-party services, though we will help you resolve issues with an order wherever we can.

10 Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement and uninterrupted or error-free operation. Prices, charts and other market data are for information only.

11 Limitation of liability

To the maximum extent permitted by law, Flux Swap is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or market losses. Our total liability for any claim relating to an order is limited to the amount of the deposit for that order. We are not liable for losses caused by an incorrect address or network you entered, by events outside our reasonable control, or by third-party providers or blockchains.

12 Indemnity

You agree to indemnify and hold Flux Swap harmless from claims, losses and expenses arising from your breach of these Terms or your misuse of the Service.

13 Intellectual property

The Flux Swap name, logo, website design and content belong to us or our licensors. You may not copy or reuse them without our permission, except as needed to use the Service.

14 Changes and termination

We may change, suspend or discontinue the Service, or update these Terms, at any time. The date at the top shows when these Terms last changed. Changes apply to orders created after they are published; orders already in progress are handled under the Terms in force when they were created.

15 General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and Flux Swap about the Service.
